Burundi’s commitment to the right to life: a critical examination of domestic laws and international obligations

This research paper critically examines the protection of the right to life in Burundi, comparing the country’s legal framework with international human rights standards. It analyzes Burundi’s domestic laws related to this right, identifying their strengths and weaknesses. Specifically, Burundi has good domestic laws that align with international laws on the Right to Life. However, the implementation of these laws is poor, largely due to the Burundi legacy of historical conflict and the political environment. The study then assesses Burundi’s practical application of these laws, focusing on investigations, justice, and accountability mechanisms. Using legal analysis and case studies, the research explores how well Burundi’s legal system adheres to international norms and how it effectively prevents violations of the right to life and ensures accountability. The findings reveal challenges such as weak enforcement, a lack of accountability, and judicial shortcomings that hinder victims’ access to justice. Unlike previous studies on broader human rights issues in Burundi, this study specifically focuses on the right to life, which demands dedicated attention. The research methodology combines doctrinal, qualitative, comparative, and content analysis, including case studies, to provide a comprehensive understanding of the relationship between law and practice. Finally, the research proposes areas for legal reform to strengthen the protection of the right to life in Burundi.
